Supporting the maximum VND 60 million for product protection registration abroad

This is the regulation in Circular 14/2019 / TT-BTC issued by the Ministry of Finance on financial management to implement the Program of intellectual property development in 2016-2020.

Funding for the implementation of the Program is ensured by the state budget, including: The scientific and technological non-business expenditure under the central budget to support projects, subjects, common activities and common tasks. The Program is directly managed by the Central Government; funding for science and technology career funded by local budgets for the implementation of the Program's local management; expenses for general activities and regular tasks of implementing the Program under local management; reciprocal implementation of national tasks implemented locally.

Besides, there are other funding sources, including: funds of organizations, individuals and enterprises participating in the implementation of the Program's tasks; funds mobilized from other lawful sources.

The Circular specifies the content and level of state budget expenditure to support the registration of protection, management and protection of intellectual property. Specifically, support funding for domestic protection registration for products and services, with priority given to the results of scientific research, key products, national products, product designs and new plant varieties: For an application for protection of an invention, no more than VND 30 million / application; For applications for registration of protection of industrial designs, a maximum of VND 15 million / application may apply.

For new plant varieties: The Ministry of Science and Technology is responsible for approving the content and level of support based on the related work and current spending norms for implementation. The maximum support level must not exceed VND 30 million / application.

Supporting funding for overseas protection registration for products and services being results of scientific research, key products, national products, product designs and new plant varieties: The Ministry of Science and Technology is responsible for approving content and support levels based on the work involved and the current spending norms (look up the possibility of protection, transactions and translation into local languages, hiring representatives regarding intellectual property in Vietnam and the country of registration, make a protection file, follow up the application for protection in the country of registration, and report explanations related issues at the request of the agency. intellectual property in the country of registration). The maximum support level must not exceed VND 60 million / application; the remaining funds (if any) shall be self-funded by organizations and individuals participating in the Program.

Financial support for organizing exhibitions and exhibitions distinguishing products protected from intellectual property rights and infringing products of intellectual property rights: The State budget shall support expenses for renting premises; transportation and design costs, staging booths; general operational expenses of the Organizing Committee (overall decoration, opening ceremony, closing ceremony, printing of documents and other related expenses). The maximum support level must not exceed VND 10 million / participating unit.

Circular 14 takes effect from May 1, 2019.
