Vinh Phuc prescribes the regime of land rent exemption, reduction and infrastructure rental rates for establishments implementing socialization in a number of sectors


On February 26, 2019, the Provincial People's Committee issued Decision No. 11/2019/QD-UBND promulgating the regulation on exemption and reduction of land rent and infrastructure rental rates for social implementation establishments in the fields of education - training, vocational training, health care, culture, sports, environment, judicial expertise in urban areas in Vinh Phuc province.

Accordingly, the subjects of application are non-public establishments established and eligible to operate under regulations of competent state agencies in the fields of socialization; organizations and individuals operating under the Enterprise Law that have investment projects, joint ventures or establishments operating in the socialized domains, which are eligible to operate under the institution's regulations. competent state officials; public non-business establishments that contribute capital, mobilize capital, enter into joint ventures or cooperation in accordance with the law on setting up independent accounting establishments or enterprises operating in the areas of socialization under decisions regulations of competent state agencies.

Conditions for enjoying preferential policies on land rent; house and infrastructure renting facilities: socializing establishments must fully meet the provisions of the Prime Minister's Decision No. 1466/QD-TTg of October 10, 2008, defining the list of expenditures. details of types, sizes and standards of establishments implementing socialization in the fields of education - training, vocational training, health care, culture, sports, environment and judicial expertise; Decision No. 693 / QD-TTg on May 6, 2013 of the Prime Minister on amending and supplementing a number of contents of the Prime Minister's Decision No. 1466/QD-TTg of October 10, 2008.

Regarding the regime of land rent exemption and reduction:

For projects in the environmental domain: including concentrated domestic wastewater treatment projects with a design capacity of 2,500m3 or more of wastewater per day and night for urban areas of grade IV or higher ; Collecting, transporting and processing concentrated solid waste; Hazardous waste treatment, co-treatment of hazardous waste; Handling and renovating polluted areas in public areas; Rescue and handling of oil spills, chemical incidents and other environmental incidents; Building technical infrastructure to protect the environment of trade village industrial parks and clusters; Relocation, conversion of facilities causing serious environmental pollution; Environmental monitoring; Cremation and cremation service; Assessment of environmental damage; environmental health assessment; environmental assessment of goods, machinery, equipment and technology; Producing and applying environmental protection patents, which are protected by the State in the form of patent or utility solution patent; Producing eco-friendly products with Vietnam Green Label as the Ministry of Natural Resources and Environment; products from recycling and waste treatment activities certified by competent state agencies; Producing gasoline, diesel fuel and biofuel with certificate of conformity; Bio char; energy from the use of wind power, sunlight, tides, geothermal and other forms of renewable energy; Manufacture and import of machinery, equipment and special-use vehicles directly used in collecting, transporting and treating wastes; environmental monitoring and analysis; renewable energy production; Treatment of environmental pollution; respond and handle environmental incidents; Production, business and service activities of eco-friendly establishments with eco-labels certified by the Ministry of Natural Resources and Environment shall be exempt from 100% of the payable land rent.

For projects in the fields of health, education - training, cocational training, culture, sports, judicial expertise invested in Vinh Yen City and Phuc Yen City: Discount 90% of money land lease to be paid; Investment in districts of Binh Xuyen, Vinh Tuong, Yen Lac, Tam Duong, Song Lo, Lap Thach and Tam Dao: Reducing 100% of the payable land rent.

Regarding rental prices of infrastructure and socialized works:

Based on the existing housing fund and infrastructure, the provincial People's Committee considers and decides to let establishments perform socialization for a definite term with a rent rate formed on the basis of the rent of assets on land and land rent (if any). In which: Establishments implementing socialization are exempted or reduced the land rent under the provisions of Decree No. 69/2008 / ND-CP dated May 30, 2008 and Decree No. 59/2014/NĐ-CP on June 16, 2014 of the Government and the regulations on land rent exemption and reduction as mentioned above; The rental price of a property on land is calculated by the minimum rent price determined on the principle of preserving the cost of forming the leased asset and covering the maintenance and maintenance cost (according to the guidance at Point 3.2, Clause 2 Article 1 of Circular No. 156/2014/TT-BTC on October 23, 2014 of the Ministry of Finance).

The provincial People's Committee assigns the Department of Natural Resources and Environment to coordinate with other departments, agencies, People's Committees of districts, cities and towns to make land use plans and plans, guide establishments to implement socialization land acquisition procedures continue to meet the needs of the development of socialized fields. At the same time, the provincial Tax Department is requested to guide establishments in implementing the procedures for tax registration, tax declaration, exemption and reduction of land rents according to regulations.

This Decision takes effect 10 days after its signing.
