B. FUNCTIONS AND DUTIES

I. Functions:

Department of Justice acts as the professional agency, which counsels and supports the provincial People’s Committee in State management of the following fields: Building-up and implementing the legal normative acts; inspecting and handling the legal normative acts; popularizing, educating the law; implementing civil sentences; notary public; certify as true; adoption with foreigners involved; the commercial arbitrators; births, deaths and marriages; nationality; criminal record; lawyers; the legal consultancy; the legal assistance; the judicial assessment; reconciliation in units; auctioning assets and other judicial operations as stipulated by the law.

II. Duties:

1. Submitting the provincial people’s committee:

a) Draft decisions, directions and other documents within jurisdiction of the people’s committee in the judicial field;

b) Drafting long-term, 5-year and annual plans, and projects, programs, methods for organization and implementation of the State administrative reform tasks, the judicial reforms, building up, completion of the legal system within State management of Department of Justice;

c) Drafting development plans for lawyer career, notary public, auctioning assets and other judicial careers in the locality within State management of Department of Justice;

d) Drafting the legal documents specifying conditions, title standards for Head, Vice Head of the organizations under management of Department of Justice; Head, Vice Head of Office of Justice under management of the district/commune/city – level people’s committee of the province (hereafter referred as the district-level people’s committee).

2. Submitting Chairman of the provincial people’s committee:

a) Drafting decisions on establishment, merging, dissolution for the organizations of Department of Justice;

b) Drafting decisions, directors enforced within jurisdiction of Chairman of the provincial people’s committee on management of the judicial operations in the locality.

3. Guiding, inspecting and organizing to implement the legal normative acts, plans, programs, projects determined, approved within management of the assigned judicial operations by the relevant authorities.

4. Building-up the legal normative acts:

a) Combining with the office of the provincial people’s committee to submit the provincial people’s committee for approval, adjustment of the programs building up the legal normative acts of the provincial people’s committee; combining with  the Home Affair Department, Department of Finance to make the expected draft program for building-up of the resolution of the provincial people’s council so that the provincial people’s committee will submit the People’s Council as stipulated by the law;

b) Combining to compose the drafts of the legal normative acts enforced within jurisdiction of the provincial people’s committee presided to compose by the other specialized agencies of the provincial people’s committee; 

c) Appraising the drafts of the legal normative acts enforced by the People’s Council and the provincial people’s committee as stipulated by the law;

d) Organizing to collect the people’s suggestions on the projects, the drafts of the legal normative acts as directed by the provincial people’s committee and Ministry of Justice.

5. Implementation of the legal normative acts:

a) Generally monitoring implementation of the legal normative acts in the locality;

b) Guiding the professional knowledge and skills of monitoring implementation of legal practice under management of the specialized agencies of the provincial people’s committee, The district-level people’s committee;

c) Summarizing, reporting implementation of the legal normative acts in the locality and proposing the methods to solve difficulties, problems in implementation of the legal normative acts to the provincial people’s committee and Ministry of Justice.

6. Inspection of the legal normative acts:

a) Supporting the provincial people’s committee in self-inspection of the documents enforced by the provincial people’s committee;

b) Inspecting the legal normative acts enforced by the People’s Council and the district-level people’s committee; instructing the specialized agencies under management of the district-level people’s committee to self-inspect the legal normative acts and inspect the legal normative acts enforced by the People’s Council and the commune, precinct, town – level people’s committee (hereafter referred as the commune-level people’s committee) as stipulated by the law;

c) Inspecting, speeding up implementation of the methods handling the illegal documents as stipulated by the law.

7. Organizing to implement checking, systematization of the legal normative acts of the People’s Council and the provincial people’s committee; instructing, inspecting implementation of checking, systematization of the legal normative acts for the district-level people’s committee, the specialized agencies under management of the provincial people’s committee.

8. Legal popularization and education:                     

a) Organizing to implement the programs, plans of legal popularization and education in the locality after Chairman of the provincial people’s committee approves;

b) Acting as the standing Council in combination of the legal popularization and education in the province;

c) Building up a team of legal reporters; composing, publishing the documents for the legal popularization and education; d)  organizing communications, propaganda, popularization, education for the law on the fields managed by Department of Justice; đ) Instructing establishment, management, exploitation of the legal bookshelves in the communes and the other agencies, units as stipulated by the law.

9. Presiding, combining with Department of Culture, Sports and Tourism and the relevant Departments to support the provincial people’s committee for instructing to build up the village conventions of hamlets, villages, teams of residents, the residential areas in convenience with the regulations of the law.

10. Supporting the provincial people’s committee for implementing the tasks, rights of the provincial people’s committee in practice of criminal sentences in the locality as stipulated by the law.

11. Notary public, certify as true:

a) Organizing to implement the plans, projects for development of notary public practicing organizations in the locality after the provincial people’s committee’s approval; advising, proposing the provincial people’s committee for implementing the support methods for development of the notary public practicing organizations;

b) Guiding, inspecting organization, operation of the notary public offices in the locality;

c) Receiving, inspecting the documents to submit the provincial people’s committee for asking for establishment, revocation of decisions for establishment of notary public offices; issuing, revoking certification for operation registration of the notary public office;

Organizing to implement the projects of establishment, dissolution of the notary public offices as approved by the provincial people’s committee;

d) Proposing Minister of Justice to appoint, dismiss notary public;

đ) Guiding, inspecting, improving the professional knowledge and skills for the specialized agencies under management of the district-level people’s committee and civil servants in charge of Justice – Births, deaths, marriages in the commune-level people’s committee on issuance of copies from the original book, certifying as true for the copies and signatures.

12. Births, deaths, marriages, nationality, adoption with foreigner involved and criminal record:

a) Guiding, directing to organize and implement registration and management of births, deaths, marriages for the district-level Office of Justice and the specialized civil servants in the commune-level people’s committee;      

b) Building up an system of births, deaths and marriages organization, registration, management, improving the professional knowledge and skills for officials in charge of births, deaths, marriages;

c) Directly solving problems of births, deaths, marriages, adoption with foreigners involved within jurisdiction as stipulated by the law and directed by the provincial people’s committee;

d) Appraising the documents, submitting the provincial people’s committee to solve the problems of births, deaths, marriages, adoption within jurisdiction of the provincial people’s committee as stipulated by the law;

đ) Proposing the provincial people’s committee to determine revocation, cancellation of the documents related to births, deaths, marriages issued by the district-level people’s committee but in opposition to the regulations of the law;

e) Managing, using, storing types of books of births, deaths, marriages, forms of births, deaths, marriages as stipulated by the law; issuing copies of the documents related to births, deaths, marriages from the book of birth, death and marriage registration;

g) Issuing Certification of Criminal Record, managing, storing the documents of criminal records as stipulated by the law;

h) Handling, investigating the documents of nationality, submitting the provincial people’s committee for consideration, proposing or solving within jurisdiction; managing, storing the documents of nationality.

13. For lawyers and legal consultancy:

a) Appraising the documents, submitting the provincial people’s committee to ask for establishment, dissolution, approval of the Charter of Delegation of Lawyers;

b) Issuing, revoking Certificates for operation registration of lawyer practicing organizations, the legal consulting centers, certificate for legal consultants;

c) Providing information on operation registration of offices of lawyer, law firms to the State agencies, organizations and individuals as requested in accordance with the regulations of the law; requesting the lawyer practicing organizations to report their operations as necessary;

d) Organizing to implement plans, projects for development of lawyer practicing organizations in the locality after the provincial people’s committee’s approval; aid consulting, proposing the provincial people’s committee for implementing the methods of support and development of lawyer practicing organizations in the locality;

đ) Organizing to improve the legal consulting skills; supporting to organize improvements of the professional knowledge and skills for the legal advisors as stipulated by the law;

e) Instructing, inspecting organization and operation of the Delegation of lawyers, lawyer-practicing organizations and the legal consulting center within jurisdiction.

14. Legal aid:

a) Managing, instructing organization and operation of centers and branches of the State legal aid center; the legal aid operations of Offices of Lawyer, Law Firms, legal consulting centers as stipulated by the law;

b) Organizing, improving the professional knowledge, skills for the subjects implementing the legal aids in scope of the locality;

c) Issuing, changing, revoking Certificate for Legal Aid Registration of Offices of Lawyer. Law Firms and the legal consulting centers;

d) Determining to accept, issue and revoke Card of Legal Aid Freelancer.

15. Asset auction:

a) Organizing to implement the planning for development of auction organizations in the locality after the provincial people’s committee’s approval; consulting, proposing the provincial people’s committee to implement the methods for support and development of auction organizations in the locality;

b) Inspecting asset auctions in scope of the locality within jurisdiction.

16. Supporting the provincial people’s committee in State management of judicial investigation, commercial arbitration as stipulated by the law.

17. Guiding, inspecting reconciliation in units as stipulated by the law.

18. Directing, instructing, inspecting the professional knowledge and skills for legislations of the specialized agencies under management of the provincial people’s committee and the State enterprises; organizing to implement and combine to implement the legal aid operations for enterprises as stipulated by the law.

19. Organizing, directing inspections for the legal practice within management of Department of Justice; solving complaints, petitions; performing prevention, fight against corruptions, waste and handling violations to the law as stipulated by the law.

20. Performing the international cooperation of law and justice as stipulated by the law.

21. Organizing the scientific and technological researches, application in the fields under State management of Department of Justice.

22. Performing the periodical and unscheduled communication, statistics, summary, and report on implementation of tasks in the assigned fields as stipulated by the provincial people’s committee and Ministry of Justice.

23. Stipulating functions, tasks, rights, job relations of professional organizations directly under management of Department of Justice, managing personnel, deploying salary regulations and policies, treatment regulations, training, improvement, commendation and award, discipline for officers, civil servants, officials  and laborers under management of Department of Justice as stipulated by the law and assigned by the provincial people’s committee

24. Instructing, inspecting implementation of autonomy, self-responsibility mechanism of public service delivery organizations directly under Department of Justice as stipulated by the law.

25. Managing finance, assets as stipulated by the law and assigned by the provincial people’s committee

26. Performing other duties as assigned by the Provincial People’s Committee or as stipulated by the law.
