II. FUNCTIONS, TASKS

1. Position and functions:

Department of Finance is a specialized agency of the Provincial People’s Committee with the function as an adviser, assisting the People’s Committee to implement the State management function about finance, budget of State; taxes, charges, fees, and other collections of State Budget; assets of State; financial funds of State; financial investment; corporate finance; accountant; independent audit; prices and activities of financial services at local area as legal regulation..  

Department of Finance has a legal personnel, particular seal and account; be directed, managed about organization, staff and assignment of the People’s Committee as well as be directed, supervised, instructed about the speciality, profession of Finance Ministry

2. Rights and obligations:  

1. To submit the Provincial People’s Committee:  

Draft decision, direction and other documents under competence of Provincial People’s Committee about financial field; Draft programs, schedules of long term, 5 years, or every year about financial field as the overall planning, scheme of the local socio-economic development; Draft programs, methods of organizing the implementation of the administrative innovation assignment under the state management scale of Department; Draft legal normative acts stipulating specifically standards of titles for the head level and deputy level of units under Department; manager, deputy manager of Plan and Finance Bureau under People’s Committee of district after unified with Department of managing the relevant branch and field. Draft plan of classifying income sources and expense tasks of each level of local budget; norm of allocating expense forecast of local budget; regime of collecting fees and contributions of population as stipulated by law in order to submit the Provincial People’s Council to decide as the competence; Forecast of adjusting local budget; solutions of balancing budget and necessary methods to complete task of receiving and spending budget assigned for the Provincial People’s Council to decide as competence; plan of re-arranging, solving housing, land owned by State under the local management scale.

2. To submit the Provincial People’s Committee: 

Draft decision, direction and other documents under issuance competence of the Chairman of Provincial People’s Committee about State management field of Department; Draft decision of establishing, merging, dividing, reorganizing, and dissolving units under Department as stipulated by law.  

3. To assist Chairman of Provincial People’s Committee to direct, instruct, supervise, inform, propagandize, publicize legal education about financial field; to organize the implementation of legal normative acts, policies, planning, schedules, programs, projects, schemes, plans under the State management scale of Department after being issued or approved by the competent authority levels.  

4. Regarding to the management of State Budget, taxes, fees, charges and other incomes of the State Budget: 

To instruct the administrative authorities, provincial non-business units and financial agencies of lower levels to make forecast of annual state budget as stipulated by law. 

To implement supervising, investigating the budget forecast of the authorities, units of the same level and lower level; to make the forecast of collecting the State Budget in provincial area, the income and expense forecast of local budget, plan of allocating budget of provincial level reporting to the Provincial People’s Committee to submit the Provincial People’s Council for decision;  

To preside over, co-ordinate with the relevant authorities to plan, submit the Provincial People’s Committee to issue documents stipulating the fee collection of using land, hiring land, hiring water surface, contribution of joint-venture capital with the value of the land use right, hiring and selling houses owned by State and others in the fields of State assets, land and mineral resources.

To instruct, supervise and hold the implementation of policies, confirm price and level of collecting fee of using land, hiring land, hiring water surface, contribution of joint-venture capital with the value of the land use right, hiring and selling houses owned by State; to co-ordinate with relevant authorities to implement assignment of managing collection of taxes, fees, charges and others in provincial area; to inspect, supervise the management and utilization of budget at authorities and unit using budgets; to require the State Treasury to pause payment as discovering that expense exceeds forecast, expense has been done wrongly with policy, regime or regime of reporting to the Government hasn’t been executed; to verify the balance of collecting the State Budget rising in district, the income and expense balance of district’s budget; to verify and inform the balance with the administrative authorities, non-business units and other organizations using the province’s budget; to approve the balance of authorized expenses of the Central Budget implemented by localities. 

To totalize the situation of collecting, spending the State Budget, to make total balance of local annual budget submitting the Provincial People’s Committee to report to the Provincial People’s Council for approval, report to Ministry of Finance. 

Management of development investment capital: 

- To co-ordinate with Department of Planning and Investment and the relevant authorities to plan forecast and solution allocating the spending forecast of annual development investment; to preside over coordinating with the relevant authorities to arrange other capital sources having nature of investment to submit the Provincial People’s Committee for decision.  

- To co-ordinate with Department of Planning and Investment to submit the Provincial People’s Committee for decision of allocating investment capital, list of investment projects using capital of budget; plan of adjusting allocation of investment capital in necessary case; to make plan of adjusting, regulating investment capital for projects invested by local budget.  

- To co-ordinate with Department of Planning and Investment and the relevant authorities to advise, assist the Provincial People’s Committee about strategy of attracting, mobilizing, using short-term and long-term investment capital at home and abroad; to make policies, methods of regulating and upgrading effects of using the official development assistance capital (ODA) in province. To assist the Provincial People’s Committee about the state management of finance for ODA projects, programs in province. 

- To take part in investment guideline; to verify, assess, contribute opinion as competence for projects managed by province.  

- To inspect situation of implementing investment capital plan, situation of managing, using investment capital; to balance investment capital belonging to local budget, of investors and financial authorities of district, situation of controlling payment of investment capital of the State Treasury of district and commune levels.  

- To organize verifying the balance of investment capital of completed projects, submitting Chairman of the Provincial People’s Committee for approval towards projects under competence of Chairman of the Provincial People’s Committee. To verify, approve the balances of projects invested by non-business capital having nature of investing local basic construction as regulations.  

- To totalize, analyze situation of mobilizing and using investment capital, evaluate effects of managing, using investment capital, balance local investment capital, report to the Provincial People’s Committee and Ministry of Finance as stipulated. 

To manage the authorized expense resources of the Central Government, manage the local financial reserve fund as legal regulations.  

To unify the management of loans and aids for locality as stipulated by law; to manage the governmental finance for foreign aids directly to locality under the local income source; to assist the Provincial People’s Committee to deploy the bond issuance and other loan forms of locality as law on State Budget; 

To instruct, check the implementation of finance self-control regime of public, non-business units, regime of self-controlling, taking responsibility by themselves for administrative management expense of the governmental administrative authorities as legal regulations; 

To instruct, check the implementation of financial disclosure regime of State budget as the legal regulations; 

To totalize the result of implementing petition of inspectors, auditors about field of budget finance reporting to the Provincial People’s Committee.  

5. Regarding to the management of governmental assets at local area:  

To make, submit the Provincial People’s Committee documents of instructing about management, utilization of governmental assets and decentralizing state management of governmental assets under local management scale;  

To instruct, check the implementation of managing governmental assets; to propose financial solutions to ensure that management and utilization of governmental assets is effective under the competence at local area;  

To decide as competence or submit the Provincial People’s Committee to decide purchasing, hiring, revoking, transferring, liquidating, selling, destroying the governmental assets, allocate governmental assets to the public non-business unit self-controlling finance for purpose of business production, service, hire, joint venture, association;  

To instruct and organize the implementation of regime of disclosing the governmental assets at authorities, organizations, units as stipulated by law;

To co-ordinate with Department of Natural Resources and Environment to instruct, supervise authorities, organizations, units at local area about the implementation of compensation, assistance and resettlement policies when Government reclaims land; 

To organize receiving, managing, submitting the Provincial People’s Committee to decide solution or solve as competence about assets that have not confirmed their ownership, assets that has been concealed, sunk and discovered; assets seized and confiscated in State fund; assets of projects using State’s capital (including ODA capital) when the project finishes, other assets are set up the ownership of State;

To organize management and exploitation of governmental assets not assigned to organization, individual for management, utilization; to manage financial sources arising in the process of managing, exploiting, transferring, solving governmental assets; 

To advise, assist the Provincial People’s Committee to propose opinions to Ministries, Branches and Ministry of Finance about arranging houses, land of the central authorities managing in the area;  

To manage data basement of the governmental assets  under local management scale; to assist the Provincial People’s Committee  to implement report of situation of managing, using the governmental assets  under local management.  

6. Regarding to management of Governmental financial funds (development investment fund; fund of guaranteeing credit of small and medium enterprises; housing development fund and other types of Governmental financial funds established as the legal regulations); 

To preside over, co-ordinate with the relevant authorities to make plan, verify documents about establishment and activities of funds, report to the Provincial People’s Committee  for approval or submit the competent level for approval; to advise, assist the Provincial People’s Committee to decide matters related to objects of investment and loan; interest; to supply charter capital for funds as stipulated by law; to monitor, check, supervise operation of funds;  to check, supervise the execution of the financial management regime and implement other tasks as assigned by the Provincial People’s Committee; to check, supervise the utilization of local budget capital mandated to the organizations authorized (development investment funds, governmental financial organizations...) to implement the disbursement, loan, interest support as the purposes confirmed by the Provincial People’s Committee.  

7. Regarding to the corporate finance management:  

To instruct the implementation of policies, regime of managing the corporation finance, co-operative finance and community economy; financial policy supports ownership conversion, re-arrangement of state enterprises, change of the public, non-business unit by enterprise, privatization of the public, non-business unit, regime of managing, preserving and developing the State capital at enterprises; to inspect the execution of law on finance, accounting of all types of enterprises in province as legal regulations; to manage capital and assets owned by state at enterprises, organizations of cooperative economy, community economy established by locality under legal regulations; to implement rights, obligations representing owner of state owned capital at enterprises as assigned by the Provincial People’s Committee; to check, supervise the management, utilization of capital, distribution of incomes, deduction and utilization of funds of state enterprises; to check, supervise, evaluate effects of operation of state enterprises; to totalize situation of changing ownership, rearranging state enterprises; to analyze, evaluate the corporation finance situation of enterprises in provincial area, situation of managing, preserving and developing state capital at enterprises established or contributed capital by locality, to report to the Provincial People’s Committee and Prime Minister of Finance Ministry; to totalize, evaluate situation of implementing financial regime supporting policy of developing co-operatives, community economy in provincial area under legal regulations.  

8. Regarding to price management and price verification:  

To preside over making price plan of commodities, services and control elements of creating price toward commodities, services as competence; to verify plan of prices of public assets, commodities, services ordered and assigned as target by State, products having sole position, which Departments, Units or enterprises settle, submit the Provincial People’s Committee for decision; to co-ordinate with the relevant authorities to organize the price negotiation , sole price control, anti-dumping price, posting price  and sale with the posted price; to verify draft decision of issuing price lists of lands at local area for Department of Natural Resources and Environment to submit the Provincial People’s Committee for decision; to preside over, co-ordinate with the relevant authorities to submit the Provincial People’s Committee to confirm specific price of land of each land field in order to submit the Provincial People’s Committee for decision; to publicize the list of commodities, services used for price stabilization, register prices, enumerate prices and announce application of price stabilization at local area as stipulated by law; to totalize, analyze and forecast the fluctuation of prices in the area; to report situation of implementing the state management assignment about prices at local area under regulations of Finance Ministry and the Provincial People’s Committee; to preside over, co-ordinate with the relevant authorities to inspect the implementation of law on prices and verify prices of organizations, individuals operating in the area.  

9. To instruct, manage and inspect the implementation of legal regulations for organization supplying the financial services under the field of finance, accounting, independent audit, financial investment, enterprises trading lottery, gambling and games with awards in the area as stipulated by law.  

10. To investigate, inspect, solve complaints, accusations; to solve as the competence or petition the competent levels to solve actions of violating legal regulations in the field of the state management scale of Department; to prevent, resist corrupt, negation and implement savings, resist the lavishment of using assets, expenses assigned as legal regulations.  

11. To stipulate functions, rights, tasks of offices, Inspection, Specialized and professional Divisions, Branches and Non-business Units under Department; to manage the staff, implement salary regime and policies, treatment regimes, education, cultivation, sanction, discipline to cadres, officials, civil servants under the management scale of Department according to the decen           tralization of the the Provincial People’s Committee and legal regulations.  

12. To implement the international cooperation about financial field as stipulated by law and assigned or authorized by the Provincial People’s Committee.

13. To organize the implementation of research, application of technical, scientific advances; to build system of information, restoration supporting the assignment of managing finance and speciality, professions assigned.  

14. To fulfill other tasks as assigned by the Provincial People’s Committee and stipulated by law.
