II. FUNCTIONS, TASKS

A. Functions:

1. Department of Home Affairs is a specialized agency of the Provincial People’s Committee with the function as an adviser, assisting the People’s Committee to implement the State management function about home affairs, including: organization of government apparatus; organization of the staff of the State non-for-profit administrative agencies; administrative innovation; local authorities; administrative border; Government officials, cadres, civil servants and officials of commune, ward, district; association organization, non-governmental organization; State archives; religion; emulation – commend and reward.

2. Department of Home Affairs has a legal personnel, particular seal and account; be directed, managed about organization, staff and assignment of the People’s Committee as well as be directed, supervised, instructed about the speciality, profession of Home Affairs Department.

B. Tasks:

1. To submit the Provincial People’s Committee the draft decisions, directions; long-term, 5 year, annual plan, schedule, and projects, scheme; programs belonged to the State management scale of the Department in provincial area. 

2. To hold the implementation of the legal normative acts, the plan, scheme, program, and project approved; to inform, propagandize, instruct, supervise, popularize, and educate the law on fields belonging to the State management scale assigned.

3. Regarding to mechanism organization: 

a. To submit the Provincial People’s Committee the decision of management classification of mechanism organization for professional agencies, state non-business units under People’s Committee of province, district levels;

b. To assess and submit the Provincial People’s Committee the decision of functions, tasks, rights and mechanism organization of professional agencies, branches under professional agencies and state non-business units belonging to the Provincial People’s Committee ; project of establishing, merging, dissolving the state non-business units under the Provincial People’s Committee so that  the Provincial People’s Committee decides according to the regulations;

c. To assess and submit the Chairman of Provincial People’s Committee the decision of establishing, merging, dissolving the interdisciplinary coordination associations of provincial level as the stipulations of law;

d. To advise, assist the Provincial People’s Committee to make plans of establishing, merging, dissolving professional agencies under People’s Committees of province, commune levels as the regulation so that Provincial People’s Committee submits the People’s Council of province for approval;

e. To co-ordinate with the same-level professional agencies to instruct the People’s Committee of district about regulations of functions, rights, tasks and organization of the professional divisions, non-business units under instruct the People’s Committee of district;

g. To preside over, co-ordinate with the relevant appropriate authorities to instruct, monitor, supervise the implementation of classification, rank of administrative authorities, non-business units of province according to the legal regulations.

4. Regarding to the management, utilization of the administration and non-business staff:

a. To build and report to the Provincial People’s Committee about plan of the local personnel to submit the People’s Council of Province for decision of the general non-business personnel at local area, which must be approved before being submitted to the authorized levels for decision;

b. To submit to Chairman of the Provincial People’s Committee about the decision of assigning target of the administrative and non-business staff;

c. To instruct management, utilization of the personnel for the professional agencies under the People’s Committees of district level and the state non-business units as stipulated by law.

5. Regarding to the government organization: 

a. To instruct organization and operation of apparatus of all levels of local government in the area; 

b. To organize and instruct assignment of electing representatives of all levels of People’s Council; to co-ordinate with relevant authorities to hold and instruct the assignment of electing members of the national assembly as stipulated by law; to summarize result of electing representatives of all levels of People’s Council; 

c. To verify, submit the Provincial People’s Committee to approve result of electing Chairman, Vice Chairman and other members of People’s Committee of district; to assist People’s Committee, People’s Council of province to submit Standing Committee of the National Assembly, Prime Minister for approval of election dignities as stipulated by law;

d. To assist People’s Committee, People’s Council of Province to train, cultivate the representative members of all levels of People’s Council; to reckon up quantity, quality of representatives of People’s Council and members of all levels of People’s Committee to synthesize, report as regulations.

6. about the assignment of administrative border and classification of administrative units:

a. To monitor, manage the assignment of administrative border in province according to legal regulations and instructions of Home Affairs Department; to prepare projects, procedures related to the establishment, mergence, division, adjustment of borders, renaming administrative unit, upgrading urban level in province to submit the authorized levels to consider and decide; to instruct and organize the implementation after having the approval decision of the authorized agency. To assist Chairman of Provincial People’s Committee to fulfill, instruct and manage the classification of administrative units of all levels as stipulated by law;

b. To synthetize and manage files, maps of borders, landmarks, administrative border of province according to instructions and regulations of Home Affairs Department;

c. To instruct, supervise operation of hamlets, villages, residential groups according to the regulations of law and Department of Home Affairs.

7. To instruct, supervise, synthetize, report the implementation of Democracy Regulations at communes, wards, towns and administrative agencies, state non-business units in provincial area as stipulated by law.

8. Regarding to the cadres, officials, civil servants:

a. To assist the Provincial People’s Committee about government management of staff of cadres, officials, civil servants and officials, civil servants of commune level.

b. To advise and submit the Provincial People’s Committee to issue procedures of employing, managing, utilizing, training, cultivating and fulfilling regulations, policies for cadres, officials, civil servants of State and commune level as stipulated by law;

c. To unify the management and implementation of plan of training, cultivating cadres, officials, civil servants at home and abroad after being approved by Provincial People’s Committee.  To instruct, supervise the assignment of employing, managing, utilizing and fulfilling policies, regimes for cadres, officials, civil servants of province;

d. To submit Chairman of the Provincial People’s Committee to decide or decide as jurisdiction of employing, evaluating, transferring, nominating, re-nominating, circulating, commending and rewarding, taking discipline and other regimes, policies for cadres, officials, civil servants under management of the Provincial People’s Committee;

đ. To instruct, supervise the implementation of regulations on standards of dignity and mechanism of government cadres, officials, civil servants; to employ, manage and utilize  cadres, officials, civil servants of government  and commune level as stipulated by law and the Department of Home Affairs;  the classification of documents of cadres, officials, civil servants is applied by regulations of law.

9. Regarding to the administration innovation:

a. To submit the Provincial People’s Committee the decision of allocating the professional agencies under the Provincial People’s Committee to be in charge of contents, jobs related to administration innovation, including: to innovate institution, organization of administrative apparatus, to build and develop the staff of cadres, officials, civil servants, to improve  the public finance, to modernize the administration; to monitor, urge and supervise the deployment of implementing as decision of the Provincial People’s Committee;

b. To submit the Provincial People’s Committee, chairman of the Provincial People’s Committee to decide policies, methods of promoting the administrative innovation, upgrading the validity and effect of management of the state administrative authorities in province; to preside over, co-ordinate with the central line agencies in provincial area to deploy the administration innovation;

c. To instruct, urge, supervise the professional agencies under the Provincial People’s Committee to deploy the administration innovation as the administration innovation programs, policies approved; the fulfillment of “one-door”, “one-s top-shop” mechanism at provincial level agencies, People’s Committee of district and commune levels as stipulated by law and directed by  Provincial People’s Committee;

d. To assist the Provincial People’s Committee to synthetize the implementation of regulations on regime of self-control, self – responsibility for utilization of tasks, organization of apparatus, personnel of public non-business units as stipulated by law; 

đ. To make report about assignment of the administration innovation to submit at the monthly meeting of the Provincial People’s Committee; to assist the Provincial People’s Committee to make report for Prime Minister, Department of Home Affairs about assignment of the administration innovation according to regulations.

10. Regarding to the assignment of organizing associations and non-governmental associations:

a. To verify, submit Chairman of the Provincial People’s Committee the decision of allowing establishing, dissolving, approving regulations of associations, non-governmental organizations in provincial area as stipulated by law;

b. To instruct, supervise the implementation of regulations towards associations, non-governmental organizations violating the stipulation of law, regulations of association;

c. To preside over, co-ordinate with professional agencies of same level to submit the Provincial People’s Committee and Chairman of the Provincial People’s Committee the decision of assisting regime, policy for associations under legal regulations.

11. Regarding to the assignment of archives, records:

a. To instruct, supervise administrative agencies, non-business organizations and state enterprises in province to follow regulations, stipulations about archives, records; 

b. To instruct, supervise specialization, profession about  collecting, protecting, preserving and organizing stored documents for authorities, units in the area and Archives Center of Province;

c. To verify, submit Chairman of the Provincial People’s Committee for approval of “List of document sources and elements belongs to kind of  handing and storing in the Archives Center of Province”; To verify “List of documents is no longer valid” of the Provincial Archives Center and archives basement of districts.

12. Regarding to the religion assignment:

a. To assist the Provincial People’s Committee to direct, instruct, supervise and organize the implementation of Party’s guideline, State’s policy and law of religion and religion assignment in provincial area;

b. To preside over, co-ordinate with the relevant authorities to fulfill the State management task about religion in provincial area under the legal regulations;

c. To instruct specialized knowledge and profession of religion assignment;

d. To be connection clue between local authorities and religion associations in provincial area.

13. Regarding to the assignment of emulation, sanction:

a. To advise, assist the Provincial People’s Committee and Chairman of the Provincial People’s Committee to direct, unify the state management, assignment of emulation, sanction; to concretize the Party’s guideline, policy, governmental law of emulation and sanction suitably with actual situation of province; To do standing task of Provincial Emulation, Sanction Council;

b. To advise, assist the Chairman of Provincial People’s Committee and Provincial Emulation, Sanction Council to hold emulation movements; to sum up partially, totalize emulation; to co-ordinate with relevant agencies to propagandize, popularize, replicate widely the advanced symbols; to hold implementing  the sanction policy of Party and State; To instruct, supervise the implementation of plan, content of emulation, sanction in provincial area; to fulfill assignment of organizing  and offering sanction forms according to regulations of law;

c. To build, manage and utilize the emulation, sanction fund under legal regulations; to manage, allocate, revoke and change the sanction objects according to the level classification and legal regulations;

d. To instruct specialty, profession about assignment of emulation, sanction.

14. To fulfill the international cooperation assignment of home affairs and fields appointed under legal regulations and allocation of Provincial People’s Committee.   

15. To fulfill assignment of supervising, inspecting home affairs; to solve complaints, accusation, prevent and resist corrupt, negativity, practice thrift, resist lavishment and solve legal violations in the assignment fields appointed by Provincial People’s Committee as stipulated by law.

16. To instruct specialty, profession about assignment of home affairs and other fields assigned for administrative agencies, non-business units under province, People’s Committee of district and commune level. To assist Provincial People’s Committee to fulfill the function of state management in the assignment fields appointed for organizations of Ministries, other central and local Branches located head-offices in provincial area.

17. To synthetize, reckon up according to the instruction of Home Affairs Department about organization of administrative agencies, non-business units; Number of non-business units with levels of district, commune, hamlet, village, mountain village, residential group; Number, quality of the staff of cadres, officials, civil servants of government and commune level; assignment of governmental archives and records; religion assignment; emulation, sanction assignment and other appointed fields.

18. To hold researching, applying scientific advances; to build system of information, archives, data supporting management assignment and speciality, profession assigned.

19. To direct and instruct activities of public services in assignment fields belonging to the management scale of Department.

20. To fulfill assignment of informing, reporting Provincial People’s Committee and Home Affairs Department about status of implementing task assigned according to regulation.

21. To manage apparatus organization, personnel, implementation of salary regime and policies, regimes of treatment, sanction, discipline, training and cultivation about speciality and profession for cadres, officials, civil servants belonging to Department as regulations.

22. To manage finance, assets of Department as stipulated by law and level classification of the Provincial People’s Committee.

23. To make decision of functions, tasks, rights, apparatus organization, assignment relation and responsibility of the leading person of organizations under Department as stipulated by law to submit the Provincial People’s Committee to decide or decided according to jurisdiction.

24. To fulfill other tasks, rights assigned by the Provincial People’s Committee, Chairman of the Provincial People’s Committee.
