II. POSSITION AND FUNCTION

Department of Planning and Investment acts as an professional agency which counsels and supports the provincial people’s committee to perform the State management of planning and investment, including: summery of socio-economic development planning; organizing operations and proposing mechanisms and policies of socio-economic management in area of the province; internal and external investments in the locality; managing Official Development Assistance (ODA); bidding; business registrations in care of the locality; summarizing and unifying management of enterprise issues, collective economy, private economy; organizing supply of public services in range of State management of the Department as stipulated by the law.

Department of Planning and Investment is under the operational and staff management of the provincial People’s Committee; also under the functional guidance and inspection of Ministry of Planning and Investment.

II. TASKS AND RIGHTS

1. Submitting the provincial People’s Committee: 

a) General planning draft, the provincial 5 year or annual strategies, plan of socio-economic development,  arranging investment capital plans under management of the local budget; the provincial investment promotion plans; the provincial main socio-economic balances; including accumulated balance and consumption, balance of development investment capital, the financial balance;  

b) Drafting an action program to perform plan of socio-economic development in accordance with Resolution of the provincial People’s Council and is responsible for monitoring, summarizing performance of monthly, quarterly, half-yearly and yearly plans, and report to the provincial people’s committee  so as to manage and cooperate to perform the main socio-economic balances of the province;

c) Drafting programs, plans to arrange and renovate State enterprises under management of the local authorities; management mechanism and support policies for arrangement of State enterprises and development of small and medium enterprises belonging to all economic elements in area of the province;

d)  Drafting decisions, directions; programs, methods to organize and realize the administrative reform tasks in the field of planning and investment under management of the Department as stipulated by the law, arranged by Ministry of Planning and Investment;

đ)  Drafting lists of internal and external investment projects for each period and adjusting them in necessary cases;

e) Drafting legal normative acts to specifically stipulate title standards for the rank of Head, Vice Head in the units under management of the Department; Manager, Deputy Manager of Financial-Planning Division belonging to district-level people’s committee after being accepted by Department of Finance as assigned by the provincial People’s committee. 

2. Submitting the provincial People’s Committee: 

a) Draft Decisions, Directions and other documents enforced by Chairman of the provincial People’s Committee relevant to the field of State management of the Department;
b) Drafting decisions of establishment, merging, separation, reorganization, dissolution for the units under management of the Department as stipulated by the law; 

c) Receiving documents of investment projects, assessing and submitting the provincial people’s committee to realize investment registration; allocating, adjusting, revoking investment certificates of investment projects under authority of the provincial people’s committee as assigned.

3. Supporting Chairman of the provincial people’s committee to direct: 

 Instruction, inspection, information, propaganda, legal and educational popularization of planning and investment; organization and performance of legal normative acts, policies, planning, plans, programs, projects under State management of the Department after enforced or approved by the relevant authorities. 

4. Planning and plan: 

a) announcing and responsible for organization and performance of the provincial general socio-economic development plan, which are approved in accordance with the stipulations;
b) Managing several fields in implementation of the plan as assigned by the provincial people’s committee;

c) Instructing Departments, committees and branches, district-level people’s committee to make planning, plans in convenience with the provincial general socio-economic development plans as approved; 

d) Combining with Department of Finance to make the provincial budget estimates and allocate the budget to agencies, organizations and units in the province.   

5. Internal investments and external investments:

a) presiding, combining with Department of Finance to make plans and allocate rate of investment and development capital into each program, project belonging to the State budget under management of the province in convenience with total investment capital and  investment mechanism in each branch and operation field; 

b) Presiding, combining with Department of Finance and the related Departments, committees and branches in inspection, supervision, assessment for capital use effect in the programs and projects in area of the province; investment supervision of the community as stipulated by the law;

c) Becoming a clue to receive, inspect, monitor, supervise, and assess investment projects in authority of the provincial people’s committee;

d) Managing internal investments and foreign direct investments in area of the province as stipulated by the law; organizing investment promotions in accordance with the plans as approved by the provincial people’s committee; instructing investment procedures as assigned. 

6. Managing ODA:

a) mobilizing, attracting and coordinating ODA management; instructing Departments, committees and branches to make catalogues and contents of programs for ODA capital use; summerizing lists of programs and projects using ODA capital to submit the provincial people’s committee for approval and report to Ministry of Planning and Investment;

b) Assessing performance of ODA programs and projects; suitably solving or petitioning Chairman of the provincial people’s committee for solving problems in arrangement of corresponding capital, disbursing to perform ODA project related to many Departments, committees, branches, district-level authorities and commune-level authorities; periodically making summery reports of ODA capital attraction and use.

7. Procurement managerment:

a) Assessing and responsible for contents of the documents submitted to Chairman of the provincial people’s committee in relation with procurement plans of projects, bidding package determined to invest by Chairman of the provincial People’s Committee; assessing and responsible for contents of documents submited to the provincial People’s Committee in relation with bidding documents, bidder selection of bid packages and projects, which the provincial people’s committee acts as an investor;

b) Instructing, monitoring, supervising, inspecting compliance of legal stipulations of procurement and summerizing, reporting performance of the approved procurement projects and procurements as stipulated.

 8. Enterprises, business registration:

a) Assessing and responsible for State enterprise establishing, arrangingt and reoganizing projects under management of the locality; summerizing State enterprise arrangement, renovation, development and development condition of enterprises belonging to other economic elements. Acting as the focal agency to preside, combine with the related agencies and organizations in making programs, plans to support for small and medium enterprise development in area of the province; coordinating, instructing and inspecting performance of supporting programs after they are aprpoved;

b) Organizing, performing and responsible for business registration procedures; registration for temporary business moratorium; newly issuing, adding, changing, reissuing and revoking business registration certificates, certificates of branch or representative office operational registration in area of the province under management of the Department; combining with branches to inspect, monitor and summerize condition and handle breaches in range of authority after enterprises are issued business registration certificates; collecting, storing and managing information of business registration as stipulated by the law.

 9. Collective economy and private economy:

a) Acting as a clue to summerize, propose collective economy and private economy development models and mechanisms, policies, plans; instructing, monitoring, summerizing and assessing prformance of collective economy and private economy development programs, plans, mechanisms, policies and operations of collective and provate economic organizations in area of the province;

b) Presiding, combinig with the related agencies to solve inter-branch problems of collective economic amd private economic development mechanisms, policies;

c) Acting as a clue to combine with internal and external organizations, individuals to research, summerize experience, build programs, projects to support and attract capital and other resouce for collective and private economic development in area of the province;

d) Periodically making reports of collective economic and private economic development condition in area of the province as instructed by Ministry of Planning and Investment and submitting to the provincial people’s committee, Ministry of Planning and Investment, related ministries and ministry-level agencies.

 10. Deploying international cooperation in planning and investment as stipulated by the law and assigned or authorized by the provincial people’s committee. 

11. Responsible for Financial Planning Division under management of the district-level people’s committee for professional instructions in planning and investment field in management range of planning and investment branch.

 12. Organizing research and application of scienctific and technical progresses; building information system, storing system to serve for State management and professional knowledge in the field as assigned.

13. Inspecting, solving complaints, accusations as stipulated by the law; handling in scope of jurisdiction  or petitioning to the related agencies to deal with legal breaches in the fields belonging to State management of the Department; preventing, against corruptions, negative issues, thrift practice and waste combat in government spending.

14. Stipulating functions, tasks, rights and job relations of public service delivery organizations, units under management of the Department; managing personnel, deploying salary regulations and policies, treatment regulations, training, improvement, commendation and award, discipline for officers, civil servants, officials belonging to State management of the Department as stipulated by the law and assigned by the provincial people’s committee.

15. Managing the allocated finance, assets as stipulated by the law and assigned by the provincial people’s committee.

16. Periodically and unscheduledly informing and reporting task performance as stipulated by the provincial people’s committee and Ministry of Planning and Investment.

 17. Realizing other tasks as assigned by the provincial people’s committee in accordance with the law
